These Terms of Service ("Terms") are a legal agreement between you and Elani Dev, LLC ("Company," "we," "our," or "us"). By accessing and using Five Why ("the Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Five Why is a subscription-based software-as-a-service (SaaS) platform that provides AI-powered coaching and problem-solving tools to help users understand the root causes of their challenges.

3. User Accounts

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Access to the Service requires a paid subscription. By subscribing, you agree to pay the fees indicated for the chosen plan. Subscriptions automatically renew unless cancelled before the renewal date.

All payments are processed through our payment provider, Stripe. Fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Share your account with others
• Use the Service to harass, abuse, or harm others

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Elani Dev, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a license to use, modify, and display that content solely for the purpose of providing the Service to you.

8. Privacy

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. The advice provided by our AI coaches is for informational purposes only and should not be considered professional counseling or therapy.

11. Limitation of Liability

To the maximum extent permitted by law, Elani Dev, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
